SUMMARY OF THE USER AGREEMENT AND PRIVACY RIGHTS STATEMENT
 

Below you will find an extensive User Agreement and Privacy Rights Statement. While we may not be fans of long-winded legalese, we have no choice but to set forth a understanding that covers all the bases. This protects us, our partners, and most importantly, you.

Given the reality that most people never do read longwinded legalese, we offer you this summary.

1. It's information only. The most important thing to understand is content and tools on this site are for informational purposes only. Just like a book on law or HR practices. Use of any materials does not create an attorney/client relationship with ANYONE unless you have a written and signed agreement indicating specifically otherwise. These materials do a great job of addressing the nuts and bolts of compliance exposure for the general employer population. They are not created to deal with unique state regulations and are not designed to address every one of your compliance exposures. They are not legal advice. This is why it is essential for you to involve an employment law attorney or seasoned HR consultant in the compliance process.

2. These materials are for your intra-company use only. If you’re an insurance agency, attorney, consultant, agency, association or other entity interested in the licensing of these materials for use with clients or others then please go to www.hrthatworks.com.

3. Copyright protection is everybody’s responsibility! One of the exciting aspects of working on a web portal is the ability to share documents. One of the limitations is copyright law. To begin with, we encourage you to manipulate our forms for the specific use of your company. Please just make sure to keep our copyright notice on the forms and all will be OK. They do not become your copyrightable property simply because you manipulate them or give them to others. If you leave the program, our forms leave with it. It would be hard to run this business any other way. Likewise, if you have a form you want us to use we’ll certainly consider it. The only caveat is we get to put the HR That Works copyright on it. If we did it any other way we couldn’t encourage Members to improve the program. Please also be clear with your other relationships about the use of any forms you are using and your own copyright caveats. For example if the docs are copy written by a third party, can you use them in the site? What happens if you leave that relationship?
We can’t police the use of other documents in the system by thousands of Members. This means everyone is responsible for their own copyright concerns.

4. Using this site does not guarantee you won't have compliance and other employee problems. We cannot insure you against compliance problems through use of these strategies and tools. If we had to do that, we could not afford to deliver these products at the fair price we do, or sometimes for free. To help protect yourself against claims not prevented by using this program, talk to your insurance broker about Employment Practices Liability Insurance (EPLI). You can learn more about it in a Special Report in the program.

5. We respect your privacy rights! Except for the Employer Advisors Network, Inc. and partners who license use of this web site for their clients and members, your name or other information will not be shared with other parties without your express consent. The administrators of HR That Works as well as their partners have the ability to see when and where you have logged on to the HR That Works website. We do this for two reasons:

  1. So we can learn what client needs are, what aspects of the site they find the most valuable and conversely, what part of the site is not being used so that we can do a better job explaining their benefit and,
  2. So we can better work with you to help implement and reap the full benefits of the HR That Works program. If you have any questions about this feature, please do not hesitate to contact us or the partner who provided your access.

Having stated the above, nothing set forth in the User Agreement takes away from the fact that these are high quality and easy-to-use and highly effective materials that will make a bottom line difference at your company. 6. A note to California Residents: It is the intent of the Privacy Policy to comply with the California law and that of all states. In summary, you must presume that we collect electronic information from all visitors. This is not usually personally identifiable. If you, purchase a product or service via this website (and thereby become covered by the Act), the purchase agreement you electronically sign prior to purchase allows the website to collect and archive all the personal information you provide and to transmit and/or transfer that personal information to third parties. In the event that the website, under advice of counsel agrees to divulge to insure that the website is releasing information to the correct party. While we take measures to ensure that outside parties do not have access to any information we have about you, we do not warranty that outside parties will not breach our system and thus have access to your information.

7. SharePoint Disclaimer: The HR That Works portal is built on Windows SharePoint Services 3.0. Partners and client companies have their own workspaces where their respective site and the related content are stored. Agency and client company administrators should not delete or try to modify any Web parts or HRThatWorks content. Since partners and client companies can upload their own content to the portal, HRThatWorks will not take the responsibility for the content published by the partners and client companies. Partners, companies and any other members may take advantage of the robust SharePoint Platform, but we are not in a position to support SharePoint changes. 8. Document Storage: As a User of the HR That Works Portal you will be allowed to upload documents and other materials to the website portal. Since we are hosting your website, we reserve the right to charge you for additional storage. If you get to that point you are really using the site and the fee will be at market rate (which generally isn’t much). So, if you decide to upload your entire movie collection to MY Documents, you’ll be asked to pay an additional storage fee.

9. VIEWING AND/OR USE AND/OR COMMUNICATION IS CONSTRUED AS ACCEPTANCE OF THE TERMS OF THIS POLICY: Acceptance of the terms of this Privacy Policy is a portion of the consideration required for your right to visit the website. If you do not accept these terms, you have no right to visit this site and you are fraudulently using this site.
